Media Addict Limited – Data Protection Policy

  1. Definitions

  • "Client" means any individual or legal entity entering into a contract with Media Addict Limited for services covered by these Terms and Conditions.

  • "Client Personal Data" refers to all information (texts, documents, designs, media, etc.) owned or controlled by the Client that is processed by Media Addict Limited in connection with the agreement.

  • "Media Deadline" is the date by which Media Addict Limited submits advertising assets to publishers or platforms.

  • "Data Protection Legislation" includes all applicable laws governing personal data processing, including the UK GDPR and EU GDPR.

  • "Media Addict Limited" refers to the company with its registered office and company number stated in the contract.

  1. Payment Terms

  • Payment terms are subject to Media Addict Limited’s standard credit checks. Non-UK clients must pay in advance.

  • A 50% non-refundable deposit is payable on booking, with the remaining 50% due within 7 days after the advertisement is published or goes live.

  • If both print and digital formats are used, the balance is due 7 days after the earliest publication date.

  1. Invoicing

  • Invoices are payable in full and exclude VAT or other applicable taxes unless otherwise agreed in writing.

  • Any deductions for agency commissions must be pre-approved in writing.

  1. Contract Formation

  • Contracts are formed at the offices of Media Addict Limited.

  • Acceptance of these terms is confirmed via written agreement, email, or an order form.

  • As this is a B2B contract, statutory cooling-off rights do not apply.

  1. Client Responsibilities

  • The Client must submit advertising materials in the required electronic format by the deadlines specified.

  • The Client warrants that all content is legal, non-defamatory, non-infringing, and compliant with the UK Advertising Codes (CAP/BCAP and other applicable regulations).

  • The Client agrees to indemnify Media Addict Limited against legal claims or losses resulting from breaches of these warranties.

  1. Editorial Discretion

  • Media Addict Limited may reject unsuitable content without liability.

  • Minor edits may be made to ensure compliance with house style or legal standards.

  • Claims must be supported by evidence; unsupported claims may be removed.

  1. Performance Delays

  • Media Addict Limited is not liable for delays caused by acts of God, strikes, technical issues, or other unforeseen events.

  • Time is not of the essence in publication schedules unless agreed otherwise.

  1. Liability & Disputes

  • Liability is limited to the amount paid by the Client for the specific advertisement.

  • Any disputes must be raised in writing within 28 days of publication.

  1. Late Payment & Interest

  • Late payments forfeit any discounts and revert to the current rate card price.

  • Statutory interest (8% above the Bank of England base rate) may be charged from the day after the invoice due date until payment is received.

  1. Cancellation Policy

  • Cancellations incur a severance fee based on proximity to the Media Deadline:

    • More than 30 days out: 33% + VAT

    • 7–30 days out: 66% + VAT

    • Within 7 days: 100% + VAT

  • For campaigns already live, cancellation fees are 100% of the contract value.

  • If content is not supplied within 72 hours of the deadline, Media Addict Limited reserves the right to proceed with assumed approval.

  1. Data Protection

  • Media Addict Limited acts as a data processor; the Client is the data controller.

  • Both parties must comply with Data Protection Legislation.

  • Media Addict Limited will:

    • process data only per the Client’s written instructions,

    • maintain appropriate records of processing,

    • implement adequate technical and organisational measures to secure data,

    • notify the Client without undue delay in case of a data breach,

    • return or securely destroy personal data upon termination of the contract, unless required by law to retain it.

  • The Client retains responsibility for:

    • ensuring a lawful basis for data processing,

    • obtaining necessary consents,

    • ensuring the accuracy of data supplied.

  • These Terms are governed by English law and subject to the non-exclusive jurisdiction of the English courts.
